Content Management System – Conditions of Use
  1. These Conditions of Use apply to the GNP Content Management System, irrespective of the country of issue. They may be revised at any time and without notice at the sole discretion of the GNP. The use of the Content Management System is taken to be your agreement to adhere to the current Conditions of Use at any given time.
  2. You are required to adhere to these Conditions of Use. You are also required to adhere to the Acceptable Use Policy ("AUP") that we publish from time to time for those components of the service that you use. If you breach them, we have the right at our sole discretion to suspend or terminate your account without notice or refund, to make an additional charge for the misuse, or to block access to the relevant component of the service.
  3. You may cancel the service at any time, provided that you give us notice at least 7 days before the date you wish your service to stop; if a payment falls due during those 7 days, we will still require payment.
  4. Except where stated otherwise, you must send us notice in one of the following ways:  by post, by fax, by email.  We will not accept proof of sending as proof that we have received your notice. You must ensure that you have received acknowledgement from us.
  5. Up to date copies of these Conditions of Use, the AUP, a glossary and an index of documents can be found at www.gngateway.org.uk
  6. The GNP reserve the right to suspend or cancel any account at their sole discretion.
  7. You are required to keep the contact details that you provided us up to date. We may send notices or other information to you at the address you gave us. We will not pass these details to other companies, [ unless for the purposes of debt recovery ].
  8. We will use our reasonable endeavours to maintain all our services. You will not be eligible for any compensation because you cannot use the service or because of a failure, suspension or withdrawal of all or part of the service. We may change the service at any time.
  9. Regardless of anything else in these Conditions of Use, our liability shall not exceed the proportionate amount of your annual payment.
  10. We shall not be liable for any consequential losses you may suffer.
  11. We are not responsible for any use you make of our services, nor for any charges that you incur with any third party, except as documented within a separate written agreement or AUP. You indemnify the GNP against the effects of any misuse or any claims resulting from that misuse.
  12. You will keep your administration passwords secret and will not disclose them to third parties for any purpose. You will notify us and change any password which you believe may have been compromised.
  13. You will not use the account for any illegal purpose.
  14. Any decision made by the GNP in relation to the services provided, Conditions of Use and AUP shall be final.
  15. These Conditions of Use and all other legal relationships between us shall be governed by and construed in accordance with English Law, and are subject to the exclusive jurisdiction of the English courts.
  16. If any part of these Conditions of Use or any AUP shall be held to be invalid or unenforceable, this shall not affect the enforceability of any other provision of these Conditions of Use or AUP.
 
Content Management System – Acceptable Use Policy
  1. The GNP accept no responsibility for loss of data, information in any form or other matters whatsoever which result from the use of this service.
  2. You will be responsible for the content of your site, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate English law.
  3. You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your site.
  4. You may not use any part of the Content Management System (e.g. website, mailing list) for commercial purposes.  However you are permitted to advertise or promote chargeable services or products which form part of a not-for-profit activity.
  5. A clearly readable warning page must be displayed before any adult material is displayed.
  6. Your site may not be used to distribute or advertise any of the following: software for sending SPAM (bulk emails, excessive news postings, etc.);  lists of email addresses except where all the addressees have given their explicit permission;  any collection of personal data other than in accordance with the Data Protection Act and the Data Protection Principles.
  7. You may not advertise your site, or cause another person to advertise it, by techniques that would be classified as abuse. This includes, but is not limited to, bulk emailing and excessive news posting. Such action will be treated as a violation of this AUP, even if it is carried out using internet access provided by a third party.
  8. The GNP shall not be held liable for any loss however occasioned as a result of the suspension, removal or unavailability of a customer's site or material stored within it.
  9. If your account is barred for any reason (e.g. non-payment) access to your site may be suspended.
  10. When you close your account, your site will be deleted.
  11. The GNP reserve the right to remove any material from the website at their sole discretion, without prior notice and without explanation.
  12. The GNP reserve the right to suspend any or all of the website at any time, without prior notice and without explanation.
  13. The GNP will require sites that they consider to be of excessive size to be modified or be charged at a higher annual fee.
  14. The GNP reserve the right to vary the definition of 'excessive size' at their sole discretion at any time without prior notice.
  15. The GNP will require sites that they consider to be using excessive bandwidth to be modified or be charged at a higher annual fee.
  16. The GNP reserve the right to vary the definition of 'excessive bandwidth' at their sole discretion at any time without prior notice.
  17. By using the content management system, you will be deemed to have agreed to and accepted the terms and conditions of use of the service.
  18. The IP address that may be allocated to your web site may be changed or withdrawn at any time without notice.
  19. The GNP reserve the right to vary the Conditions of Use and acceptable use policy for the Content Management System at their sole discretion at any time and without prior notice.
  20. You must ensure that you do not further the sending of unsolicited bulk email or any other form of email or Usenet "abuse". This applies to both material which originates from your organisation and also third party material which passes through it (for example, emails sent by third parties using the Mailing List plugin which is provided as part of the Content Management System).
  21. Any decision made by the GNP in relation to this service shall be final.
